COSTA MESA, Calif., June 9, 2010 – Attorneys at Rutan & Tucker, LLP recently achieved a significant victory in a jury trial in Santa Clara County Superior Court that involved a historic building in downtown San Jose that was damaged during the construction of an adjacent condominium project. William Eliopoulos, a partner in Rutan & Tucker’s Trial Section and Construction Law Group, along with attorneys Kaveh Badiei and Zack Broslavsky, represented the owner of the historic structure. Eliopoulos is based in the firm’s Palo Alto office. Rutan & Tucker attorneys argued that the developer utilized damaging construction techniques in stabilizing the soft soil under its own 24-story high-rise condominium building, which resulted in significant damage to the neighboring historic building. The five-week-long trial involved more than 300 exhibits and 25 witnesses. Rutan & Tucker’s client was awarded compensatory damages of over $2 million, which is expected to increase with the award of reimbursable expenses. “We are very pleased with the great result achieved by Rutan & Tucker attorneys in this important jury trial,” said Mark B. Frazier, head of the firm’s Trial Section. “This case gave our firm the opportunity to draw upon our considerable construction law experience as well as our trial expertise on behalf of our client.”
