Rutan & Tucker's Financial Practices Group is comprised of attorneys with specialized knowledge and expertise in issues concerning financial institutions, creditors' rights, and bankruptcy. The Group includes both litigators and transactional attorneys from the Firm's various Sections.

The litigators in the Group practice in all California federal and state courts and have experience in all aspects of commercial litigation. We routinely handle actions for the foreclosure of real and personal property liens, enforcement of guarantees and assignments of rents, and related creditor-debtor matters, both complex and routine. We regularly litigate applications for writs of attachment and for the appointment of receivers, claim and delivery proceedings and preliminary injunction matters. We represent secured creditors in all phases of business bankruptcy cases, including negotiation of cash collateral stipulations and plans of reorganization, prosecution of non-dischargeability and relief from stay actions, and defense of creditors in actions to avoid pre-bankruptcy transfers and in objections to claims litigation. The Firm also has significant experience defending class action matters.

The transactional attorneys in the Group represent both borrowers and lenders in secured and unsecured real and personal property loan transactions, including construction and permanent financing, shared appreciation loans, bond financing, mixed collateral financing, debt restructures and loan workouts, as well as alternative financing structures such as sale-leaseback transactions, syndications, securities offerings, ground leasing, and redevelopment transactions.
